These Terms and Conditions govern your use of our website located at www.BonitaGymnasticsAcademy.com and your participation in our gymnastics and tumbling programs, classes, camps, private lessons, birthday parties, open gym sessions, and other activities offered at our facility located at 12622 Trade Way Dr. Unit 6, Bonita Springs, FL 34135. By using our Site or enrolling in our programs, you agree to be bound by these Terms in full. Please read these Terms carefully before registering for any of our services. If you do not agree with any part of these Terms, you must not use our Site or participate in our programs. These Terms constitute a legally binding agreement between you and Bonita Gymnastics Academy and are governed by the laws of the State of Florida and the United States of America.
ENROLLMENT AND REGISTRATION
All participants must complete a registration form and sign a waiver before participating in any
classes, camps, or activities at our facility. Registration forms must be completed accurately and
truthfully, including all medical conditions, allergies, and emergency contact information. We
reserve the right to refuse enrollment or to dismiss any participant whose behavior, health, or
medical condition poses a risk to themselves or others. Enrollment in our programs is on a first-
come, first-served basis and class sizes are limited to maintain our low student-to-coach ratios.
We reserve the right to combine, split, or cancel classes based on enrollment numbers and
availability of coaching staff. Participants must be placed in classes appropriate for their age and
skill level as determined by our coaching staff. We reserve the right to evaluate participants and
recommend class changes based on their progress and skill development. Parents and guardians
are responsible for ensuring their children attend the correct classes at the scheduled times.
FEES AND PAYMENTS
All fees for classes, camps, private lessons, birthday parties, open gym sessions, and other
services are due at the time of registration unless otherwise specified. We accept payments via
cash, credit card, and other payment methods specified at the time of enrollment. Tuition fees are
non-refundable except as expressly provided in our refund policy. We charge an annual
registration fee for all enrolled students which is non-refundable and due upon initial enrollment
and each subsequent anniversary year. Payment plans may be available for certain programs and
are subject to approval by our management. Late payments may result in a late fee and
suspension of participation until the balance is paid in full. Returned checks or declined credit card
transactions will incur a processing fee and the outstanding balance must be paid immediately.
Prices and fees are subject to change at any time without prior notice, although changes will not

affect already paid enrollments. We strive to keep our pricing competitive and transparent for all
our families.
CODE OF CONDUCT
We are committed to providing a safe, positive, and respectful environment for all participants,
coaches, staff, and families. All participants are expected to behave respectfully toward coaches,
staff, and fellow students at all times. Bullying, teasing, inappropriate language, and disruptive
behavior will not be tolerated and may result in dismissal from our programs. Parents and
guardians are expected to model respectful behavior and support our coaching staff in maintaining
a positive learning environment. We reserve the right to dismiss any participant whose behavior
consistently disrupts classes or poses a safety concern. We encourage parents to address any
concerns with our management team in a respectful and constructive manner. All participants
must follow safety rules and instructions given by our coaches and staff at all times.
HEALTH AND SAFETY
Participants must be in good health and physically able to participate in gymnastics and tumbling
activities. Parents and guardians must disclose any medical conditions, allergies, injuries, or
physical limitations that may affect their child's participation. We reserve the right to request a
physician's clearance for any participant with a medical condition that may impact their safety.
Participants with contagious illnesses or injuries must not attend classes until they are cleared to
return by a medical professional. Our staff is trained in basic first aid and emergency procedures
to handle minor injuries. In the event of a serious injury or medical emergency, we will contact
emergency services and notify parents or guardians immediately. We are not responsible for
injuries that occur as a result of a participant's failure to follow safety instructions or disclose
medical conditions.

ASSUMPTION OF RISK
Gymnastics and tumbling are physically demanding activities that carry inherent risks of injury,
including but not limited to sprains, fractures, and head injuries. You acknowledge that you and
your child understand these risks and voluntarily choose to participate in our programs. You
assume all risks associated with participation in our programs and activities. We take reasonable
precautions to minimize risks, including proper supervision, equipment maintenance, and safety
protocols. However, we cannot eliminate all risks associated with physical activity and
participation. You agree to hold us harmless from any claims arising from injuries that occur during
participation in our programs. We encourage all participants to listen to their bodies and to
communicate any pain or discomfort to their coaches immediately. Your signature on our waiver
form indicates your understanding and acceptance of these risks.
LIABILITY WAIVER
By enrolling in our programs and signing our waiver form, you release Bonita Gymnastics
Academy, its owners, coaches, staff, and affiliates from any and all liability for injuries, damages,
or losses sustained during participation in our activities. This waiver applies to all claims arising
from participation in classes, camps, open gyms, private lessons, birthday parties, and all other
programs offered at our facility. You agree to indemnify and hold us harmless from any claims
brought by third parties arising from your or your child's participation in our programs. This waiver
is valid for the duration of your child's enrollment and for any subsequent enrollments without the
need to sign a new waiver. You understand that this waiver releases us from liability for injuries
that may occur even if caused by our negligence. We encourage you to ask any questions you
have about this waiver before signing.
INTELLECTUAL PROPERTY
All content on our website, including text, graphics, logos, images, and software, is the property of
Bonita Gymnastics Academy and is protected by copyright and trademark laws. You may not
reproduce, distribute, modify, or republish any content from our Site without our prior written
consent. Our logos and brand names are trademarks of Bonita Gymnastics Academy and may not
be used without our permission. You may share our content for personal, non-commercial
purposes provided you give proper attribution to us. Unauthorized use of our intellectual property
may result in legal action.
WEBSITE USE
You agree to use our website solely for lawful purposes and in compliance with these Terms. You

and marketing purposes. By enrolling in our programs, you grant us permission to use images of
your child in our marketing materials, social media, and website. You may opt out of this
permission by notifying us in writing at the time of enrollment or at any time thereafter. We will not
use images for any commercial purpose outside of promoting our business. We will not publish
identifying information such as full names alongside images without explicit consent. We respect
your privacy and will honor any requests to exclude your child from photography.
GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law
provisions. Any disputes arising from these Terms or your participation in our programs shall be
resolved in the state or federal courts located in Lee County, Florida. You agree to submit to the
exclusive jurisdiction of such courts for the resolution of any disputes. In the event of a dispute,
you agree to first attempt to resolve the matter informally by contacting us directly. If informal
resolution fails, any legal action must be brought within one year of the claim arising. We both
agree to waive any right to a trial by jury for disputes arising under these Terms.
CHANGES TO THESE TERMS
We reserve the right to update or modify these Terms at any time without prior notice. Any
changes will be effective immediately upon posting on our website. We encourage you to review
these Terms periodically to stay informed of any updates. Your continued use of our Site and
participation in our programs after any changes constitutes your acceptance of the updated
Terms. We will endeavor to notify you of significant changes via email or announcements at our
